Analysis Group Consultants Summarize ABA Webinar Exploring Ex Ante Regulation of Digital Platforms Across the Globe

Analysis Group Associates Rolando Campusano and Guilherme Neves Silveira have published a summary of the American Bar Association (ABA) webinar “Digital Ex-Ante Regulation Goes Global” on the ABA’s Antitrust Law Section website. The two economists provide an overview of a panel discussion among moderator Amadeu Ribeiro (DLA Piper) and panelists Brenda Gisela Hernandez-Ramirez (Federal Economic Competition Commission), Natalia Caroprese (Uber), Barbara Luvizotto (iFood), and Niki Iatrou (McCarthy Tétrault). The webinar was cosponsored by the ABA’s Corporate Counseling Committee, International Committee, Legislation Committee, and Media and Technology Committee.

Drs. Campusano and Neves Silveira summarize the panelists’ discussion of the complexities associated with implementing ex ante regulation (i.e., regulation that seeks to prevent predicted harmful conduct from occurring) on digital platforms in Canada, Brazil, and Mexico. The discussion began with Mr. Ribeiro inviting each panelist to describe the current state and challenges of regulation to digital platforms in their respective regions. They then explored how competition enforcement agencies collaborate and align objectives with other regulatory bodies in their jurisdictions. Mr. Ribeiro closed by asking the panelists to share their thoughts about future challenges that competition enforcement for digital platforms may face, as well as how regulation can adapt to address them.
