Vice President Joshua White Explores the Choice, Design, and Implementation of Merger Remedies at Concurrences Event

Vice President Joshua White provided an overview of the choice, design, and implementation of remedies in complex merger transactions during the “Remedies in EU, UK and US Transactions” panel at the Concurrences International Mergers Conference. Mr. White explained the relevant considerations for choosing between behavioral and structural remedies in vertical and horizontal transactions. He also explored the use of behavioral testing and consumer insight research in remedy design. Finally, Mr. White described competition authorities’ varying approaches to choosing and implementing remedies, as well what actions companies should take to anticipate and address potential regulatory concerns. His co-panelists explored topics such as issues related to behavioral remedies and the importance of convergence in the choice and implementation of remedies.
